These Terms and Conditions govern the use of the e-commerce website www.canada-immigration.org (the “Site”), which is owned and operated by RW Immigration Services Incorporated (the “Company”).

By accessing or using the Site, you acknowledge that you have read, understood, and agree to comply with these Terms and Conditions at all times. Please be aware that these Terms and Conditions include a dispute resolution clause that may affect your legal rights concerning the resolution of disputes.


Intellectual Property

All content published on the Site, including but not limited to images, text, logos, and downloadable files, is the property of the Company and its original content creators.


Age Restrictions

Users of the Site must be at least 18 years of age. By using the Site, you confirm that you are over 18 years old, and the Company assumes no legal responsibility for any false statements regarding age.


Sale of Membership Subscriptions, Goods, and Services

These Terms and Conditions apply to the membership subscriptions and the sale of goods and services available on the Site, including all Membership Subscriptions, the DIY (Do-it-Yourself) Immigration Kit, and the Canada Immigration Consultation Service provided by a licensed Regulated Canadian Immigration Consultant (RCIC). Payment for membership subscriptions, goods, and services is due in full at the time of ordering.

All information, descriptions, or images provided about the goods and services on the Site are as accurate as possible. However, the Company is not legally bound by such information, and you agree to purchase goods and services from the Site at your own risk. The Company reserves the right to modify, reject, or cancel any order at any time. If the Company cancels your order after processing your payment, you will receive a refund equal to the amount paid.


Payments

The Site accepts payments by credit cards only. By providing payment information, you authorize the Company to charge the amount due to the payment instrument you have selected. The Company reserves the right to cancel or reverse your transaction if it believes your payment violates any law or these Terms and Conditions.


Consumer Protection Law

If consumer protection legislation applies in your jurisdiction and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be interpreted subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

The Company and its directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, or expenses, including legal fees, arising from your use of the Site.


Indemnity

By using the Site, you agree to indemnify and hold harmless the Company and its directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, or expenses, including legal fees, arising from your use of the Site or your violation of these Terms and Conditions.


Applicable Law

These Terms and Conditions are governed by the laws of the Province of Ontario.


Dispute Resolution

If you and the Company are unable to resolve any dispute through informal discussion, you agree to first submit the issue to a non-binding mediator and, if mediation fails, to an arbitrator. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and the Company. Notwithstanding any other provision in these Terms and Conditions, you and the Company retain the right to bring an action in small claims court and to seek injunctive relief.
